After the project had been started, Mr. Geyer provided pictures of previous construction done to the pool and spa showing that the pool light conduit and electrical had been illegally modified. Originally, the light junction box was installed in the concrete deck and the entire pool deck was at one level. Construction had been performed and the concrete deck containing the pool light junction box had since been raised which resulted in an obstruction in the pool light conduit. These pre-existing modifications were not disclosed by the homeowner. The Contract Terms and Conditions specifically stated that “If the junction box of your light(s) is in the pool deck, or is not at least 12” above the maximum water level, we CANNOT replace your pool light(s) in their existing configuration, and a Change Order will need to be processed for the additional electrical work necessary at additional cost to you the Customer. If we are contracted to replace your lights an additional cost will apply if any electrical upgrades are necessary.”
We offered Mr. Geyer the following options: 1) Install a “dummy” light (a light fixture with no wiring; this light would be non-functional) and credit the initial $250 charge of replacing the light; 2) Install a new light and provide all necessary repairs to ensure that the conduit and electrical meet code and safety standards for an additional cost; or 3) to contract separately with another company to remove the light cord, and correct the currently unsafe and out of code condition of the electrical conduit and pool light. Mr. Geyer thanked us for our patience and understanding and responded with. “I appreciate your response to my email and thank you for crediting me for the light installation charge... I will have to work with my contractror in the future to figure it all out. Thank you for your understanding, Mike Geyer”.
